''Iedereen met beschermde muziek op zijn website ontvangt vanaf vandaag eerst een brief waarin de eigenaar van de website wordt gevraagd een licentie af te sluiten bij Buma/Stemra voor het gebruik van de muziek op zijn site", zegt een woordvoerster.

"De eigenaar wordt ook de mogelijkheid gegeven om de muziek van zijn site te verwijderen. Met YouTube verwachtte directeur juridische zaken Cees van Rij nog dit jaar tot zaken te komen. Eigenaar Google van de videosite, reageert: "Wij spreken regelmatig met rechtenorganisaties als Buma Stemra in heel Europa, maar we hebben verder niets specifieks te melden."

Hyves

Volgens oprichter Raymond Spanjar houdt Hyves vast aan haar huidige beleid. "Er is in het verleden wel contact geweest met Buma/Stemra," zegt hij. "Maar wat ons betreft verandert er niets."

"Wij kunnen niet pro-actief controleren of materiaal op Hyves met een licentie is gepost, daarvoor is de site te groot. Maar als rechthebbenden met klachten contact opnemen, wordt het gewraakte materiaal verwijderd," licht Spanjar de huidige procedure toe.

Kritiek

De kritiek op de plannen van Buma/Stemra neemt ondertussen toe. Zo stelde digitale-burgerrechtenbeweging Bits of Freedom (BoF) vrijdag in allerijl een open brief (PDF) op van vijf kantjes, waarin BoF betoogt dat muzikanten juist belang hebben bij het embedden van hun werk: dat zorgt er voor dat hun composities een groot publiek bereiken. Ook heeft BoF twijfels bij de juridische basis voor de plannen.

De organisatie had de brief dinsdag in Hoofddorp willen aanbieden, maar mocht van Buma/Stemra tijdens de persconferentie niet naar binnen.

Het tijdschrift Computer Idee startte een petitie tegen de plannen op zijn website, en ook verschillende particulieren verzamelen digitale handtekeningen.

Kamervragen

Vrijdag stelde het CDA al kamervragen over de nieuwe tarieven, bevreesd dat ouders gepeperde rekeningen zouden ontvangen voor de Hyves-activiteiten van hun kroost, en dinsdag deed GroenLinks hetzelfde.

Die partij is bang dat het plan "het voor veel muzikanten moeilijker maakt om hun muziek en optredens onder de aandacht te brengen van (potentiële) fans", en zal "leiden tot onzekerheid bij websitebeheerders, willekeur en rechtsongelijkheid".

Juridisch

Ook plaatst de partij vraagtekens bij de juridische houdbaarheid van de plannen: het staat in de huidige jurisprudentie nog lang niet vast dat embedden een vorm van openbaarmaking is waarvoor een aparte licentie nodig is.

Dat erkende ook Van Rij: "Wij denken dat het juridisch klopt, maar het is kan zijn dat een rechter daar anders over denkt." Hij wilde niet zeggen wat er gebeurt als dat inderdaad zo blijkt te zijn.
